What is VAWA?

The Violence Against Women Act (VAWA) provides important protections for victims of domestic violence, dating violence, sexual assault, and stalking. Under VAWA, you cannot be denied housing assistance, evicted, or lose your voucher solely because you are a victim of abuse.

These protections apply to all applicants and participants in the Housing Choice Voucher (HCV) program, Public Housing, and other HUD-assisted housing programs β€” regardless of sex, gender identity, or sexual orientation.

Who is Protected?

You are covered by VAWA if you are:

  • An applicant for HUD housing programs

  • A tenant currently receiving HUD housing assistance

  • A participant in the Housing Choice Voucher program


Housing Protections Under VAWA

VAWA gives you the following rights:

  • You cannot be denied admission or lose assistance because of your status as a victim.

  • You cannot be evicted solely due to the violence committed against you.

  • You may request an emergency transfer if you fear for your safety.

  • You may request a lease bifurcation to remove the abuser from the lease while keeping your assistance.


Confidentiality

Your privacy is protected. Any information you provide about the abuse will be kept confidential. It will not be shared with others unless:

  • You give written permission,

  • It is required by law, or

  • It is needed to complete an eviction proceeding against the abuser.


How to Request VAWA Protections

If you need to request protections under VAWA:

  1. Complete the Certification of Domestic Violence, Dating Violence, Sexual Assault, or Stalking (HUD-5382) form, or provide documentation from a doctor, lawyer, victim service provider, or other professional.

  2. Submit your documentation to your assigned Housing Authority worker.

  3. For emergency transfers, complete the Emergency Transfer Request (HUD-5383).

Emergency Transfers

If you believe you are in danger, you may request an emergency transfer to another safe unit. While the Housing Authority cannot guarantee a unit will be immediately available, we will make every effort to assist you in relocating.
